Minimum Wage Law
The Fair Labor Standards Act (FLSA) establishes standards for minimum wages, overtime pay, record keeping, and child labor. These standards affect more than 100 million workers, both full-time and part-time, in the private and public sectors. The federal minimum wage is $5.15/hour. For youths under 20 years of age, an employer must not pay a wage of less than $4.25 an hour during the first 90 consecutive calendar days of the youth’s employment. Under the Act, employers may not displace any employee to hire someone at the youth minimum wage.
There are a number of additional important items in the Fair Labor Standards Act of which all employers should be aware. For more detailed information on compliance with the FLSA, the Williamsburg Office of Economic Development strongly recommends that all employers visit the following website to familiarize themselves with both the act and the necessary conditions for compliance:
http://www.dol.gov/compliance/laws/comp-flsa.htm.
Perhaps most important is the fact that every employer of employees subject to the Fair Labor Standards Act's minimum wage provisions must post, and keep posted, a notice explaining the Act in a conspicuous place in all of their establishments so as to permit employees to readily read it. A downloadable version of the poster can be found at: http://www.dol.gov/esa/regs/compliance/posters/flsa.htm.
Additionally, there are a number of posters that all Virginia businesses, both public and private, must display. Complete details about minimum wage law compliance in Virginia can be obtained from the Virginia Department of Labor:
